1. Agreement to Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Simplify Apps Studio ("we," "us," or "our") concerning your access to and use of the Habit.do mobile application and associated services (collectively, the "Application" or "Service").

By downloading, installing, accessing, or using Habit.do, you agree that you have read, understood, and agreed to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, YOU ARE EXPRESSLY PROHIBITED FROM USING THE APPLICATION AND MUST DISCONTINUE USE IMMEDIATELY.

2. Description of Service

Habit.do is a habit tracking, daily routine planning, streak analysis, and productivity management application. The Service allows users to create habits, track daily progress, organize to-do items, view completion heatmaps and statistics, configure local notifications, and synchronize data across devices.

Account Types & Eligibility

  1. Age Requirement: You must be at least 13 years old (or 16 years old in certain legal jurisdictions) to use Habit.do. By using the Application, you represent and warrant that you meet this age requirement.
  2. Guest Mode: You may use the Application anonymously in Guest Mode without creating an account. In Guest Mode, your habit data is saved locally on your device.
  3. Registered Accounts: To access cloud synchronization and backup features, you may sign in using Google Sign-In or Sign in with Apple. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.

3. Subscriptions and In-App Purchases

A. Free and Pro Tiers

Habit.do offers basic features free of charge. Access to premium features (e.g., unlimited habit tracking, advanced heatmaps, customizable themes, home screen widgets, and ad-free experience) may require a paid Habit.do Pro subscription or one-time in-app purchase.

B. Billing & Payment Processing

  • All purchases, subscriptions, and payments are processed securely through the Google Play Store (for Android) or Apple App Store (for iOS).
  • Prices are displayed in the Application before purchase and may vary by region or promotional offers.
  • Applicable taxes (sales tax, VAT, etc.) are determined and collected by the respective App Store platform.

C. Auto-Renewable Subscriptions

  • Subscriptions automatically renew at the end of each billing cycle (e.g., monthly or annually) unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your App Store / Google Play account will be charged for renewal within 24 hours prior to the end of the current billing period at the then-current subscription rate.

D. Managing & Canceling Subscriptions

  • You can manage or cancel your subscription at any time through your device's account settings:
  • iOS: Open Settings > Tap your Name > Subscriptions > Select Habit.do > Cancel.
  • Android: Open Google Play Store > Tap your Profile Icon > Payments & Subscriptions > Subscriptions > Select Habit.do > Cancel.
  • Canceling a subscription disables auto-renewal. You will retain access to Pro features until the end of the current billing period.

E. Refunds

Refund requests are governed by the refund policies of the Google Play Store or Apple App Store. Simplify Apps Studio does not directly process or issue cash refunds for purchases made through third-party application stores.

4. User Content and License

A. Ownership of Your Content

You retain all ownership rights to any habit titles, notes, categories, routines, or to-do items you submit, store, or create within Habit.do ("User Content").

B. License to Simplify Apps Studio

By creating User Content within the Application, you grant Simplify Apps Studio a worldwide, non-exclusive, royalty-free license to host, store, back up, transmit, and display your User Content solely for the purpose of operating, maintaining, synchronizing, and providing the Service to you.

5. Acceptable Use and Restrictions

When using Habit.do, you agree not to:

  1. Reverse Engineer: Copy, modify, decompile, reverse engineer, or attempt to extract the source code of the Application or any component thereof.
  2. Unauthorized Access: Access or attempt to access non-public areas of the Application, database servers, or third-party backend services.
  3. Interference: Disable, circumvent, or interfere with security features, subscription validation mechanisms, or paywall controls.
  4. Automated Scraping: Use bots, scrapers, automated scripts, or tools to harvest data from the Application.
  5. Illegal Conduct: Use the Application for any unlawful, fraud-related, or unauthorized purpose under applicable local, national, or international laws.
  6. Malicious Content: Upload or transmit viruses, malware, trojans, or logic bombs that could disrupt or damage the Application or connected infrastructure.

6. Intellectual Property Rights

The Application, including its source code, database architecture, design system, graphics, icons, text, logos, user interface elements, and brand assets ("Habit.do"), is owned by or licensed to Simplify Apps Studio and is protected by copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms, Simplify Apps Studio grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Application on your personal mobile device strictly for personal, non-commercial purposes.

7. Third-Party Services and Advertisements

A. Third-Party Services

Habit.do integrates with third-party software development kits (SDKs) and cloud services, including Google Firebase, Mixpanel, Superwall, and Google Mobile Ads (AdMob). Your use of features reliant on these third-party services is subject to their respective terms and privacy policies.

B. Advertisements

For users on the free tier, Habit.do may display banner or native advertisements powered by Google AdMob. We are not responsible for the availability, content, or accuracy of third-party products or services advertised within the Application.

8. Disclaimer of Health and Professional Advice

HABIT.DO IS A PERSONAL PRODUCTIVITY AND HABIT TRACKING TOOL ONLY.

The Application does not provide medical, psychological, psychiatric, health, or professional wellness advice. Any habit tracking, reminders, or recommendations generated within the Application are for motivational and educational purposes only. Always consult a qualified healthcare or medical professional for health, mental wellness, or medical advice.

9. Disclaimer of Warranties

THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, SIMPLIFY APPS STUDIO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • WARRANTIES THAT THE APPLICATION WILL BE UNINTERRUPTED, TIMELY, SECURE, ACCURATE, OR ERROR-FREE.
  • WARRANTIES REGARDING THE PRESERVATION OR SAFETY OF DATA STORED LOCALLY OR IN THE CLOUD.

YOU ACKNOWLEDGE THAT YOUR USE OF THE APPLICATION AND ANY RELIANCE UPON DATA GENERATED BY IT IS AT YOUR SOLE RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SIMPLIFY APPS STUDIO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
  • ANY DAMAGES RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.
  • ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA OR TRANSMISSIONS.

IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF $50 USD OR THE TOTAL AMOUNT PAID BY YOU TO SIMPLIFY APPS STUDIO FOR THE APPLICATION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Termination and Account Deletion

A. Termination by You

You may stop using the Application at any time. You can permanently delete your account and cloud data directly within the Application (Settings > Account > Delete Account) or by emailing habit.tick@atomicmail.io.

B. Termination by Us

We reserve the right to suspend or terminate your access to the Application at our sole discretion, without prior notice, if we believe you have breached these Terms or engaged in fraudulent or abusive activities.

12. Changes to Terms

We reserve the right to modify, amend, or replace these Terms at any time. Any changes will be posted within this document with an updated "Last Updated" date. Your continued use of Habit.do after the posting of any revised Terms constitutes your acceptance of those changes.
